第一大變化： 簽證降低要求，初中對(duì)華首次放開，高二畢業(yè)就可以讀TAFE

移民部DIBP將開始大幅調(diào)整對(duì)海外學(xué)生設(shè)立的風(fēng)險(xiǎn)等級(jí)架構(gòu)?，F(xiàn)有四級(jí)風(fēng)險(xiǎn)都將降為三級(jí)，而原有五級(jí)風(fēng)險(xiǎn)簡(jiǎn)化為三級(jí)（即一級(jí)為低風(fēng)險(xiǎn)，二級(jí)為中等風(fēng)險(xiǎn)，三級(jí)為高風(fēng)險(xiǎn)），具體要求我們舉例來(lái)分析一下。

先拿571中學(xué)簽證來(lái)說：

- 擔(dān)保要求降低：風(fēng)險(xiǎn)等級(jí)架構(gòu)變更后，擔(dān)保金要求也從定期存款6個(gè)月覆蓋24個(gè)月學(xué)費(fèi)生活費(fèi)降低為存款3個(gè)月只要覆蓋12個(gè)月的擔(dān)保金。

- 小學(xué)6年級(jí)畢業(yè)就可申請(qǐng)澳洲的學(xué)生簽證（571類），入讀7年級(jí)（初一），而此前需要初中畢業(yè)才可申請(qǐng)留學(xué)10年級(jí)（相當(dāng)于高一）。但是移民局同時(shí)指出孩子如果上9年級(jí)必須小于17周歲, 8年級(jí)必須小于16周歲，7年級(jí)必須小于15周歲。

再拿572職業(yè)教育培訓(xùn)簽證來(lái)說:

- 中學(xué)生完成11年級(jí)高二即可申請(qǐng)澳洲的技術(shù)專修課程（572類），此前需要中學(xué)12年級(jí)畢業(yè)才可申請(qǐng)。

- 申請(qǐng)技能專修課程（572類）簽證，配語(yǔ)言課程的最低要求下調(diào)為均分4.5，而此前要求均分5.0才可以。語(yǔ)言課程的允許長(zhǎng)度增加到30周

-資金擔(dān)保要求只需計(jì)算開始12個(gè)月的學(xué)費(fèi)和生活費(fèi)，此前要求計(jì)算18個(gè)月。擔(dān)保金需要存款3個(gè)月或者是銀行留學(xué)貸款。

Schedule 5A requirements of AL 3 for subclass 571, an applicant who is proposing to undertake:

Year 9, should be less than 17 when commencing Year 9

Year 10, should be less than 18 when commencing Year 10

Year 11, should be less than 19 when commencing Year 11 and

Year 12, should be less than 20 when commencing Year 12.

For studies at the Year 8 level or below:

AL 3 Schools Sector applicants must provide evidence (under 571.231), that they are of an appropriate age for their entry level to their principal course. This is to ensure students at the year 8 level or lower will meet the age requirements above if they pross to years 9-12 - see section 89 Schools Sector - Schedule 2 requirements

AL 4 and 5 applicants must not undertake studies at the year 8 level or lower unless they are a secondary exchange student (as per 5A303(2) and 5A306(2)).

值得提醒大家的是，對(duì)于三級(jí)風(fēng)險(xiǎn)簽證來(lái)說，風(fēng)險(xiǎn)等級(jí)架構(gòu)變更前，任何人都可成為三級(jí)風(fēng)險(xiǎn)等級(jí)申請(qǐng)人的資金擔(dān)保人。但架構(gòu)變更后，所有三級(jí)風(fēng)險(xiǎn)等級(jí)的申請(qǐng)人提供的資金必須出自申請(qǐng)人“本人，或配偶，或父母，或祖父母，或兄弟姐妹，或居住在澳洲，身為澳洲永居或澳洲公民的叔伯姑舅姨”。這個(gè)本來(lái)是等級(jí)四對(duì)資金擔(dān)保人的要求，變更后將適用于所有等級(jí)三（高風(fēng)險(xiǎn)國(guó)家及地區(qū)）的資金擔(dān)保人。不過百利留學(xué)認(rèn)為這個(gè)對(duì)于中國(guó)留學(xué)生家庭應(yīng)該也不是問題，571和572原來(lái)就是四級(jí)風(fēng)險(xiǎn)，可以用留學(xué)貸款來(lái)對(duì)付；573的本科碩士簽證目前主要走SVP相當(dāng)于一級(jí)風(fēng)險(xiǎn)，簽證無(wú)需擔(dān)保金和英文考試成績(jī)！

總體來(lái)說，此次調(diào)整為申請(qǐng)者帶來(lái)的更多是正面的積極消息，很多急于把孩子帶離霧霾和沉重壓力的家長(zhǎng)，現(xiàn)在就可以行動(dòng)啦。

第二大變化：移民局嚴(yán)懲造假者，發(fā)現(xiàn)造假10年內(nèi)不可以進(jìn)來(lái)澳洲

澳大利亞移民局規(guī)定對(duì)于申請(qǐng)技術(shù)、商業(yè)、臨居、學(xué)生和家庭類簽證的申請(qǐng)人，如果發(fā)現(xiàn)有材料作假，違反PIC4020條款，那么10年內(nèi)再申請(qǐng)這些簽證都會(huì)拒簽。因?yàn)樽骷俦痪芎?，是很難得到部長(zhǎng)豁免的。

Visas affected by PIC 4020

If you have applied for any of the following visas, you must isfy PIC 4020:

skilled migration

business

temporary visas

student visas

family visas.

From 22 March 2014, new provisions will be added to the current PIC 4020. As part of this new requirement you must satisfy us of your identity to be granted a visa.

This requirement is not subject to a waiver. If you are rused a visa because you do not meet PIC 4020 on identity grounds, another visa that includes PIC 4020 as part of the critieria will not be granted to you for a period of 10 years after rusal.

This means if we are not satisfied of your identity:

your visa might be rused; and

if it is rused on that basis, you cannot be granted another visa (where that visa includes PIC 4020 as part of the criteria) for 10 years

From 22/03/2014 the Migration Regulations were amended by Schedule 1 of SLI 2014:

1. to introduce a new requirement into Public Interest Criteria (PIC) 4020 - clause 4020(2A) - for any visa which requires the applicant to meet PIC 4020, the applicant is required to satisfy the Minister as to their identity

2. to introduce a new requirement into PIC 4020 - clause 4020(2B) - for any visa which requires the applicant to meet PIC 4020, the Minister must be satisfied that the applicant or a member of the family unit of the applicant has not been rused a visa in the 10 year period bore the time of application due to failing to satisfy the Minister as to their identity.

The 10 year period applies to rusals made under the new identity requirements, not to rusals made under clauses 4020 (1) and (2).The 10 year period operates concurrently, not cumulatively, with a second 10 period under clause 4020(2B), or with the 3 year time period under clause 4020(2).

Unlike the Minister’s ability to waive the requirements of clauses 4020(1) and (2), the Minister does not have the ability to waive the new identity related requirements.The purpose of this amendment is to strengthen the integrity of the migration program and to deter identity fraud by introducing strict consequences where a visa is rused because the applicant, or a member of their family unit, failed to satisfy the Minister as to their identity.

第三大變化：移民局增加信用卡手續(xù)費(fèi)收費(fèi)

目前澳洲簽證主要走電子簽證eVisa，信用卡公司要向移民局收手續(xù)費(fèi)，移民局決定把這些費(fèi)用轉(zhuǎn)嫁給申請(qǐng)人，所以大家遞交簽證的時(shí)候記得多準(zhǔn)備一點(diǎn)。

第四個(gè)變化：8202條款簽證違規(guī)不再被100%驅(qū)逐

如果留學(xué)生在澳洲出勤率不夠、成績(jī)不好而被匯報(bào)到移民局，即使學(xué)生解釋通過，等到續(xù)簽的時(shí)候，簽證官照樣以違反8202條款拒簽，MRT仲裁庭也說這個(gè)是法律無(wú)法推翻。澳洲微信：abcstudent

From 22/03/2014, Schedule 2 of the Migration Regulations was amended to repeal the visa criterion relating to ‘substantial compliance’. This criterion was removed to provide decision makers with the discretion to take into account exceptional circumstances that may have led to a Student visa holder unintentionally breaching a condition of their Student visa. Exceptional circumstances may include upheaval in the student’s home country, illness or bereavement.

第五大變化：143父母付費(fèi)移民費(fèi)用增加

父母付費(fèi)移民的好處很多，大概1年半可以拿到PR，不過初期投資也不少，3月22日前每人42800澳元，3.22后估計(jì)會(huì)到45000-48000之間。

From 22/03/2014, the Migration Regulations were amended to increase the visa application charge for Contributory Parent (Migrant) (Class CA) visa and Contributory Aged Parent (Residence) (Class DG) visa to the limit prescribed by the Migration (Visa Application) Charge Act 1997. The amendments also correct technical errors in these provisions.
